OPERATING STATEMENT

Dream Keys Texas (hereinafter, the “Merchant” or the “Entity”) operates an eCommerce platform dedicated to the commercialization and distribution of digital artwork and related products, including, without limitation, apparel, accessories, framed prints, drinkware, keychains, and professional images.

Such activities are conducted in strict compliance with the federal laws of the United States of America, as well as applicable state laws and other regulations in the relevant jurisdictions, including those relating to consumer protection, eCommerce, advertising, and commercial transactions.

ACCEPTANCE OF TERMS

Accessing, using, purchasing products, or participating in any promotion, offer, or activity provided by the Sponsor constitutes your (hereinafter, the “Participant”) acknowledgment, understanding, and express and irrevocable agreement to be legally bound by these Terms and Conditions, as well as all applicable laws, rules, and regulations in the relevant jurisdiction.

NO PURCHASE NECESSARY (LEGALLY REQUIRED DISCLOSURE)

NO PURCHASE, PAYMENT, OR CONSIDERATION OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION.

A purchase or transaction does not increase, enhance, or otherwise affect the chances of winning. This promotion is void and without effect where prohibited, restricted, or subject to legal requirements not complied with.

DIGITAL PRODUCTS

The Sponsor offers digital products consisting exclusively of downloadable artwork delivered electronically, which do not involve the delivery of tangible goods.

Unless expressly stated otherwise in the specific terms of a given promotion or offer, the purchase of physical products is not required to participate in such promotions.

METHODS OF ENTRY

Participation in this promotion may be carried out through any of the following methods:

(a) Entry via purchase:Participants may receive one or more entries through the purchase of products offered by the Sponsor, in accordance with the specific terms established for the applicable promotion.

(b) Alternative Method of Entry (“AMOE”) – Free Entry:Participants may enter without making any purchase by using the Alternative Method of Entry (“AMOE”), in compliance with applicable United States laws.

ELIGIBILITY

This promotion is open only to natural persons who are legal residents of the United States of America and who are at least eighteen (18) years of age at the time of participation.

Participation is expressly limited to jurisdictions where the promotion is legally valid and permitted. The promotion shall be void, invalid, or without effect in any state, territory, or jurisdiction where it is prohibited, restricted, or subject to legal requirements not complied with.

WINNER SELECTION

Potential winners will be selected through a random drawing from among all valid and eligible entries received during the promotion period.

The odds of winning depend solely on the total number of valid and eligible entries received, in accordance with these Terms and Conditions.

WINNER’S TAX RESPONSIBILITY

The winner shall be solely and exclusively responsible for compliance with all applicable tax obligations, including, without limitation, any federal, state, or local taxes that may arise from the acceptance, receipt, use, or enjoyment of the prize.

The Sponsor shall bear no responsibility for such tax obligations and may, to the extent required by law, report the value of the prize to the appropriate tax authorities and/or require the winner to submit necessary documentation for tax compliance purposes.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the United States of America and the laws of the State of Texas, without giving effect to any conflict of laws principles that would require the application of the laws of another jurisdiction.

Any controversy, claim, or dispute arising out of or relating to these Terms and Conditions, their interpretation, validity, performance, or breach, shall be submitted exclusively to the jurisdiction and venue of the state and/or federal courts located in the State of Texas, and the parties expressly waive any other jurisdiction that may correspond to them by reason of their present or future domicile or for any other reason.

SEVERABILITY

In the event that any provision, clause, or part of these Terms and Conditions is held to be invalid, illegal, void, or unenforceable by a court of competent jurisdiction, such determination shall not affect the validity, legality, or enforceability of the remaining provisions, which shall remain in full force and effect.

Furthermore, the affected provision shall be interpreted, to the extent possible, in a manner consistent with applicable law in order to reflect the original intent of the parties.

This promotion is not sponsored, endorsed, administered by, or associated with, directly or indirectly, Apple Inc. or any of its subsidiaries or affiliates.

Apple Inc. does not participate in the organization, administration, execution, or winner selection process of this promotion and assumes no responsibility, directly or indirectly, in connection with any aspect thereof, including, without limitation, its development, operation, or results.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the Sponsor, as well as its affiliates, directors, employees, agents, and representatives, shall not be liable for any damages, losses, or injuries of any kind, whether direct, indirect, incidental, consequential, special, or punitive, arising out of or related to participation in this promotion, access to or use of the website, or the acceptance, possession, use, or enjoyment of any prize.

Without limiting the foregoing, the Participant acknowledges and agrees that participation is undertaken at their own risk and expressly waives any claims against the Sponsor arising from the foregoing, to the extent permitted by applicable law.

GENERAL CONDITIONS

The Sponsor reserves the right, at its sole and absolute discretion, to modify, suspend, interrupt, or cancel this promotion, in whole or in part, at any time and without prior notice, in the event that, in its reasonable judgment, circumstances arise that compromise or may compromise the integrity, legality, security, or proper operation of the promotion, including, without limitation, acts of fraud, tampering, human or technical errors, computer system failures, network interruptions, or any other event beyond its reasonable control.

In such cases, the Sponsor may also, at its sole discretion, disqualify any participant who is deemed to have engaged in fraudulent practices or actions contrary to these Terms and Conditions, without giving rise to any claim, compensation, or liability of any kind, to the extent permitted by applicable law.
